This section contains a sample of national policies and legal instruments that address common property tenure regimes. Several of the policies protecting common tenure regimes are inadequate and provide little protection for access and rights to the commons. Such inadequacies and ambiguities in national legislation and policy creates room for the privatization of the commons and undermines the legal authority of local governance institutions to manage and use the commons.
